Coca-Cola's “Hy-Vee and Coca-Cola DAYTONA 500®” Sweepstakes

1. Eligibility: The Coca-Cola “Hy-Vee and Coca-Cola DAYTONA 500®” Sweepstakes (the “Sweepstakes”) is open only to legal U.S. residents, residing in Iowa, Illinois, Kansas, Minnesota, Missouri, Nebraska, South Dakota, and Wisconsin who are 18 years of age or older at the time of entry. Employees of The Coca-Cola Company (“Sponsor”), Hy-Vee Inc. (“Hy-Vee”), NASCAR, LLC and their respective parent and/or affiliate companies, employees, as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee, are not eligible to enter and win. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void outside of the listed states and where prohibited by law.
2. Sponsor: The Coca-Cola Company, One Coca-Cola Plaza, Atlanta, GA 30313.
3. Agreement to Official Rules: By participating in the Sweepstakes, entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor, which are final and binding in all matters related to the Sweepstakes.
4. Promotion Period: The Sweepstakes begins at 12:00 a.m. Central Time ("CT") April 29, 2020, and ends at 11:59 p.m. CT October 31, 2020 (the "Promotion Period"). Hy-Vee, Inc.’s computer is the official time-keeping device for this Sweepstakes.
5. How to Enter: There are 2 ways to enter:
a) Purchase $15 of Coca-Cola Products at Hy-Vee Using Loyalty Card Method: For this method of entry, you must first have the Hy-Vee Fuel Saver + Perks® Card. For more information, visit: https://www.hy-vee.com/perks/. During the Promotion Period, if you are eligible, visit a participating Hy-Vee location and purchase $15.00 of Coca Cola or Dasani products in a single transaction, and present your Hy-Vee Fuel Saver + Perks® Card at the time of purchase. Once you have successfully done so, you will automatically receive one entry into the Sweepstakes (“Entry”).
b) Mail-In Entry: To enter the Sweepstakes without making an in-store purchase, hand-print “ATTN –Hy-Vee and Coca-Cola DAYTONA 500®– Entry” along with your name, address, city, state, zip code, telephone number, and email address (if applicable) and date of birth on a plain 3” x 5” card and mail it with sufficient postage affixed, to: ATTN – Hy-Vee and Coca-Cola DAYTONA 500® Sweepstakes – Entry, 5820 Westown Parkway, West Des Moines, Iowa 50266-8223 (each an “Entry”). There is a limit of one (1) Mail-In Entry per day during the Promotion Period. Mail-In Entries must be postmarked during the Promotion Period and received by November 6, 2020.
6. Drawing: On or about November 13, 2020, Hy-Vee will select the names of the potential winners in a random drawing of all eligible Entries received during the Promotion Period. Drawing will be conducted by Hy-Vee, whose decisions are final on all matters relating to the Sweepstakes. The potential winners will be notified by email, mail or phone and shall be required to accept the Prize within twenty-four (24) hours of notification or said Prize shall be deemed refused. Mail-in Prize Winners will be notified using the personal information they provided at the time of Entry. Odds of winning depend on the total number of eligible Entries received during the Promotion Period.
7. Requirements of Potential Winners: Potential winners must continue to comply with the Official Rules. Winning is contingent upon fulfilling all requirements. A potential winner will be required to sign and return, within 2 days of the date notice or attempted notice, an Affidavit of Eligibility and Publicity/Liability release form and an IRS W-9 form (i.e., Request for Taxpayer Identification Number and Certification). If a potential prize winner fails to provide an Affidavit of Eligibility and Publicity/Liability release form or any other requested information (as applicable), he/she may be disqualified and forfeit the applicable prize. The execution of additional releases and/or waivers of liability required by Daytona International Speedway, LLC and/or any other applicable sanctioning body or prize provider may also be required and must be returned within the time period specified by such entities, as appropriate. In the event that a potential winner cannot be contacted, forfeits the prize, or is disqualified for any reason, if time permits, Sponsor will select an alternate potential winner in a random drawing from among all remaining eligible Entries, up to 3 alternates. If the alternate potential winners are disqualified, the applicable prize will not be awarded.
8. Prizes/Prize Conditions/Release:
1 GRAND PRIZE: One prize winner will win a VIP Package for two (2) to the 2021 DAYTONA 500® (“The Event”) in Daytona Beach, Florida. The VIP Package includes: a hotel package for two (2) with arrival on Friday, February 12, 2021, and departure on Monday, February 15, 2021; a $1000.00 gift card to apply towards round-trip air transportation to attend the Event; VIP access for two (2) for the NASCAR XFINITY Series™ race on Saturday, February 13, 2021 and VIP access for two (2) for the NASCAR Cup Series™ race on Sunday, February 14, 2021; access to hospitality in the Daytona 500 Club with select catered food and beverage on Sunday, February 14, 2021; access to Victory Lane; a $200.00 gift card; pre-race VIP access e/ FANZONE access; and a souvenir gift and Event program. Approximate retail value of the Grand Prize is $4,400.
If the travel companion is a minor, his/her parent or legal guardian must be the Grand Prize Winner. A minor will not be allowed to participate in any portion of the trip without being accompanied by his or her parent or legal guardian who also executed the Release, as applicable, on said minor’s behalf. Travel companion (or winner on behalf of minor travel companion) must execute a Release of liability prior to travel. The Winner and his/her travel companion must travel together on the same itinerary and must have valid travel documents (e.g. valid government-issued photo ID). Sponsor and the Released Parties are not responsible for lost, mutilated or stolen travel documents. Grand Prize Winner and his/her travel companion are responsible for all costs and expenses associated with the Grand Prize not specifically listed as part of the Grand Prize, including, but not limited to, meals, taxes, gratuities, incidentals, merchandise and souvenir purchases. Grand Prize Winner and his/her travel companion agree to travel on dates specified by Sponsor and comply with all applicable venue regulations in connection with the Grand Prize. Sponsor and the Released Parties are not responsible for flight postponement or cancellation. In the event the Grand Prize Winner or his/her travel companion engages in behavior that (as determined by Sponsor in Sponsor’s sole discretion) is inappropriate or threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person, Sponsor reserves the right to terminate the remainder of the trip and send the Grand Prize Winner and his/her travel companion home early with no further compensation to Grand Prize Winner. Sponsor, the Released Parties and Event officials as applicable, will not be responsible for Acts of God, acts of terrorism, civil disturbances, work stoppage, governmental regulation or mandate, or any other natural disaster outside their control that may cause the cancellation of the Event and ultimately the terms and conditions of the Event tickets awarded as the Grand Prize will govern in any of these cases. In the event the Event is cancelled or postponed due to circumstances beyond Sponsor’s control, that portion of the prize will not be awarded and no additional compensation will be provided.
The Grand Prize may not be transferred and must be accepted as awarded. Winner may not request cash or a substitute prize.
10 SECOND PRIZES: Ten (10) prize winners will each win one (1) one-hundred dollar ($100.00) Hy-Vee gift card. Approximate retail value of each second prize is $100.00, and $1,000.00 for the total approximate retail value of all second prizes.
Terms and conditions on gift cards including any expiration dates apply. No prize may be transferred and must be accepted as awarded.
By entering this Sweepstakes and/or accepting any prize, entrant agrees: (1) to release, discharge and hold harmless Sponsor, Daytona International Speedway, LLC, NASCAR, LLC, each of their respective parents, subsidiaries, limited liability and affiliated companies, advertising and promotion agencies, and each of their respective shareholders, officers, directors, employees, members, successors, representatives, agents and assigns, and City of Daytona Beach, and the County of Volusia (collectively, the “Released Parties”) from liability of any kind or nature for any loss, claims, damages, or injuries of any kind resulting in whole or in part, directly or indirectly from entrant’s participation in this Sweepstakes or from the acceptance and use/misuse of any prize; and (2) to abide by, and be bound by these Official Rules and the decisions of the Sponsor relating to participation in the Sweepstakes, selection of winners and awarding of prizes, which shall be final. Acceptance of any prize constitutes permission to use winner’s name, biographical information, city and state of residence, voice, photograph, image and/or likeness for advertising, promotional and other purposes in any and all media now known or hereafter devised, worldwide, in perpetuity, without further compensation, notification or permission from entrant or any third party and without prior notice, approval or inspection, and to execute specific consent to such use if asked to do so, unless prohibited by law. Released Parties are not responsible for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of Entries, the announcement of the prizes, or in any Sweepstakes-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Released Parties are not responsible for injury or damage to any person's computer related to or resulting from participating in this Sweepstakes or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Sweepstakes or website, who act in an unsportsmanlike or disruptive manner or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Should any portion of the Sweepstakes be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, or should the Sweepstakes be unable to run as planned for any other reason, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Sweepstakes and, if terminated, at its discretion, select the potential winners in a random drawing from among all eligible, non-suspect Entries received prior to action taken. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. In the event of a dispute regarding Entries received from multiple users having the same e-mail account, the authorized subscriber of the e-mail account at the time of entry will be deemed to be the entrant and must comply with these Official Rules. “Authorized account subscriber of the e-mail account” is the natural person who is assigned the e-mail address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning e-mail addresses.
9. Publicity: Except where prohibited, participation in the Sweepstakes constitutes the consent of each entrant to Sponsor’s and its agents’ use of entrant’s name age, photograph, voice, likeness and/or image, and hometown address for promotional purposes in any media, worldwide, without further payment or consideration.
10. Additional Limitations of Liability: Sponsor and the Released Parties shall not be responsible for any problems that may arise, including but not limited to: (a) entries that are late, lost, illegible, mechanically reproduced, contain false information, damaged, misdirected, mutilated, garbled or incomplete, altered or otherwise irregular, that have been submitted using robotic, programmed, script or any other automated means, or illicit means, or do not conform with or satisfy any or all of the conditions set out in the Official Rules, as determined by Sponsor in its sole and absolute discretion; (b) postal delays, strikes or failures; (c) communications failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions or hardware or software malfunctions, failures or difficulties; (d) for any other errors of any kind, omissions, incorrect or inaccurate information relating to or in connection with the any Sweepstakes-related materials or the Sweepstakes, whether human, mechanical, clerical, electronic, or technical in nature; (e) the incorrect or inaccurate capture of information, or the failure to capture any information in connection with the Sweepstakes; or (f) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of any Prize.
11. Governing Law/Disputes: This Sweepstakes is governed by the laws of the United States and the State of Georgia. As a condition of participating in this Sweepstakes, each entrant (or entrant’s parent or legal guardian, if entrant is a minor) agrees, to the extent permitted by law, that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or in connection with this Sweepstakes, will be resolved individually, without resort to any form of class action, exclusively before a court located in the State of Georgia. FURTHER, IN ANY DISPUTE, UNDER NO CIRCUMSTANCES WILL YOU BE PERMITTED TO OBTAIN AWARDS FOR, AND YOU HEREBY WAIVE ALL RIGHTS TO CLAIM, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING ATTORNEYS’ FEES, OTHER THAN YOUR ACTUAL OUT-OF-POCKET EXPENSES (E.G. COSTS ASSOCIATED WITH ENTERING). YOU FURTHER WAIVE ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR INCREASED.
