1. ELIGIBILTY: No purchase necessary. A purchase will not increase the chances of winning. Must be 18 or older to nominate a school (K-12) and student (K-12) legally residing in IA, IL, NE, KS, MO, SD and MN. Open to individual, legal residents of IA, IL, NE, KS, MO, SD and MN who are 18 years of age or older. Employees of Hy-Vee and their respective corporate affiliates, successors and/or assigns, subsidiaries and agents, advertising and promotion agencies involved in any way with this promotion and members of their immediate family (spouse and parents, siblings and children of their spouse) and persons living in the same household of such individuals are not eligible to participate or win a prize, except as a student at a winning school. Void outside IA, IL, NE, KS, MO, SD and MN and where prohibited.
2. HOW TO ENTER: To enter the Hy-Vee “Smiles for Education” promotion complete an official registration form found in participating Hy-Vee stores or Hy-Vee Drugstores. The registration form must be completely filled out with your name, address and daytime phone number, nominated school name and address and nominated student’s name. Limit one entry per person per week. Sponsor not responsible for late, lost, damaged, illegible, incomplete, incorrect or misdirected entries. All entries become the property of the Sponsor and will not be returned.
3. PRIZES: The “Smiles for Education” promotion will begin the week of August 26, 2009 and run for eight consecutive weeks concluding the week of October 14, 2009. Ten nominated schools throughout the Hy-Vee trade area will be selected at random by a representative of Hy-Vee to be one of the weekly winners of $5,000 each and the nominated student will receive a MacBook 13” White 2.1GHz Intel Core Duo with 1GB memory. There will be a total of 80 winning schools and students for this eight week promotion. Total ARV of all prizes: $480,279.44. Odds of winning will be determined by the number of eligible entries received for each participating store. Limit: one (1) prize per school and student.
4. GENERAL CONDITIONS: No cash redemption, substitution or transfer of prize permitted, except by Sponsor, who reserves the right to substitute in whole or in part, prize of comparable or greater value if stated prize is unavailable. All federal, state and local taxes on prize and expenses relating to acceptance and use of prize are the sole responsibility of winner. Prize winners will be notified by telephone and will be required to sign and return an affidavit of eligibility and liability/publicity release (except where prohibited by law). If a winner cannot be reached after two attempts via phone, prize will be forfeited and may be awarded to an alternate winner. By participating, entrants agree to: (a) be bound by these official rules and the decisions of Sponsor and judges which shall be final and binding in all aspects relating to the promotion and (b) release and forever discharge and covenant not to sue Hy-Vee and their affiliates, subsidiaries, distributors, agents and advertising & promotion agencies and the employees, directors and officers of each of the foregoing entities from any and all claims, demands, damages, losses and liabilities, of any nature whatsoever, which they may now or hereafter assert, including but not limited to claims for injury, death, damages, or illness arising out of or relating to or claimed to be arising out of or relating to promotion entry, prize acceptance or use or misuse of the prize or any product or prize certificate awarded including, without limitation, personal injury, death and property damage. Acceptance of a prize constitutes winner’s agreement and permission to the use of his/her name and/or photograph for advertising, publicity and promotional purposes without further notice or compensation (unless prohibited by law). Sponsor and its agents are not responsible for any printing or other errors in promotion related material. This promotion will be governed by the laws of the United States.
