HY-VEE NEW YEAR, NEW YOU WEIGHT LOSS CONTEST

OFFICIAL RULES

1. Contest Eligibility. The Hy-Vee Store #1437 New Year, New You Weight Loss Contest (the "Contest") is open to legal residents of Iowa, Illinois, Minnesota, South Dakota, Nebraska, Kansas, Missouri, and Wisconsin. Entrants must be at least eighteen (18) years old at the time of entry. Employees of Hy-Vee, Inc. ("Hy-Vee") and its parent and/or affiliate companies, as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee, are not eligible to enter. The Contest is subject to all applicable federal, state, and local laws and regulations and is void where prohibited. Participation constitutes an Entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Contest. Winning a Prize is contingent upon Entrants fulfilling all requirements set forth herein. In the event of a conflict between the entry instructions on any entry form and these Official Rules, these Official Rules shall control.

2. Contest Period. The Contest runs from January 13, 2020, to March 24, 2020.

3. Sponsor. Hy-Vee, Inc., 5820 Westown Parkway, West Des Moines, Iowa 50266-8223.

4. To Enter. You must pay a $10.00 cash registration fee and complete two (2) body measurements, in person, with the Hy-Vee staff dietitian, at Hy-Vee Store #1437, 2400 2nd Avenue, Muscatine, IA 52761. The first measurement must occur on January 11, 2020, between 9:00 a.m. and 11:00 a.m. or January 13, 2020, between 7:00 a.m. and 1:00 p.m. or 4:00 p.m. and 6:00 p.m. The second and final measurement must take place on March 24, 2020, between 7:00 a.m. and 1:00 p.m. or 4:00 p.m. and 6:00 p.m.

5. Selection of Winner and Prize. The entrant that loses the greatest percentage of body weight using the following formula: ((initial weight – final weight)/initial weight), will be declared the winner. The winner will receive 50% of the total registration entry fees and will be allowed to choose a local charity to receive the remaining 50% of the registration entry fees. Total prize value depends on the total number of eligible entrants. Sponsor shall use its best efforts to contact the prize winner upon completion of the final measurement and calculation of each entrant’s weight loss. All federal, state, and local tax liabilities are the sole responsibility of the prize winner. The prize winner will be required to complete and return an Affidavit of Eligibility and Publicity/Liability release form. The prize winner may be required to complete and return an IRS W-9 form (i.e., Request for Taxpayer Identification Number and Certification) within five (5) days of issuance. Prizes are non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion.

6. Assumption of Risk, Waiver of Liability, and Indemnification. You acknowledge that there are risks associated with your participation in the Contest and that by participating, you agree to assume those risks. By entering the Contest, each participant agrees to follow these Official Rules and to release, discharge, and hold harmless Hy-Vee, and its affiliates, subsidiaries, and agents, together with the present and future officers, agents, employees and representatives of each of them, from any and all responsibility or liability whatsoever for any property loss, damage, personal injury, or death, in connection with any person’s participation in the Contest.

7. No Guaranty of Weight Loss or Body Transformation. Individual weight loss results vary and participation in the Contest does not guarantee weight loss. Factors such as diet and genetic makeup, overall health, or physiological differences may influence weight loss. Please consult your physician before beginning any new nutrition or exercise program.

8. General Conditions. No entrant shall use any artificial, inappropriate or unsafe means of weight loss in order to win the Contest. All interpretations of these Official Rules shall be made by Hy-Vee, whose decisions and interpretations shall be final and binding. Hy-Vee reserves the right to cancel, terminate or suspend this Contest or any part of this Contest for any reason. Hy-Vee reserves the right, at its sole discretion, to disqualify any individual it reasonably suspects or believes to be tampering with the entry process, any part of the Contest itself, or the award mechanism by any means or suspected to be acting in violation of these Official Rules or any other term or condition of the Contest set by Hy-Vee. If Hy-Vee determines, in its sole discretion, that unforeseen events have compromised the integrity or viability of the Contest, Hy-Vee reserves the right to void the entries at issue, and/or terminate the relevant portion of the Contest, including the entire Contest, and/or modify the Contest. Hy-Vee shall not be responsible for lost, incomplete or late entries, measurements or for any entries or measurements that are not received by Hy-Vee by the applicable deadline for any reason whatsoever.

9. Publicity. Except where prohibited, participation in the Contest constitutes the consent of each Entrant and Prize Winner to Sponsor’s and its agents’ use of Entrant’s and Prize Winner’s name age, photograph, voice, likeness and/or image, and hometown address for promotional purposes in any media, worldwide, without further payment or consideration.

10. GOVERNING LAW/DISPUTES: This Contest is governed by the laws of the United States and the State of Iowa. As a condition of participating in this Contest and/or accepting a prize, each Entrant and prize winner agrees, to the extent permitted by law, that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or in connection with this Contest, will be resolved individually, without resort to any form of class action, exclusively before a court located in the State of Iowa. FURTHER, IN ANY DISPUTE, UNDER NO CIRCUMSTANCES WILL YOU BE PERMITTED TO OBTAIN AWARDS FOR, AND YOU HEREBY WAIVE ALL RIGHTS TO CLAIM, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING ATTORNEYS’ FEES, OTHER THAN YOUR ACTUAL OUT-OF-POCKET EXPENSES (E.G. COSTS ASSOCIATED WITH ENTERING). YOU FURTHER WAIVE ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR INCREASED.

12. All requests for official winners list must be received by May 1, 2020.
